II. Nature of the Products
All objects sold by DÉRIVE STUDIO sp. z o.o. are works of art, collectible design objects, or artistic installations.
Due to their artistic, experimental, and often handcrafted nature:
minor irregularities, variations, surface marks, and material characteristics are intentional and inherent to the work,
objects are not industrial products and are not intended for functional, load-bearing, safety-critical, or everyday utilitarian use, unless explicitly stated otherwise in writing.
By placing an order, the buyer acknowledges that the objects are acquired primarily for artistic, exhibition, spatial, or collectible purposes.
III. Right of Withdrawal (Consumers)
If you are purchasing as a consumer, you have the right to withdraw from the contract in accordance with Polish consumer law.
A consumer is a natural person entering into a contract for purposes not directly related to their business or professional activity.
Right of Withdrawal
You have the right to withdraw from this contract within 14 days, without giving any reason.
The withdrawal period expires 14 days from the day on which you or a third party indicated by you (other than the carrier) takes possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision by means of a clear written statement (e.g. email).
To meet the withdrawal deadline, it is sufficient to send the notification before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except additional costs resulting from the choice of a delivery method other than the least expensive standard delivery).
Reimbursement will be made within 14 days from the date we are informed of your decision, using the same payment method as the original transaction.
We may withhold reimbursement until we have received the returned goods or proof that the goods have been returned.
The consumer bears the direct cost of returning the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
custom-made works,
objects produced to individual specifications,
unique or limited artistic works created on demand,
site-specific installations.
IV. Prices and Payments
All prices are final prices and include applicable taxes, unless stated otherwise.
Shipping, handling, and installation costs (if applicable) are calculated separately.
The customer is responsible for providing complete and accurate delivery details. Additional costs resulting from incorrect information shall be borne by the customer.
V. Retention of Title
The goods remain the property of DÉRIVE STUDIO sp. z o.o. until full payment has been received.
VI. Delivery and Risk
Delivery is carried out via courier or dedicated transport, depending on the nature of the object.
For consumers, the risk of accidental loss or damage passes upon delivery of the goods.
Delivery times may be extended due to force majeure or circumstances beyond the company’s reasonable control, including but not limited to production delays, transport disruptions, or material shortages.
VII. Warranty
Consumers are entitled to statutory warranty rights under Polish law.
Given the artistic and non-industrial nature of the objects:
aesthetic features, material variations, and traces of craftsmanship do not constitute defects,
differences between images and the delivered object may occur and are acceptable.
Business customers must report any defects in writing within 7 days of delivery; failure to do so shall result in the loss of warranty claims.
VIII. Limitation of Liability
DÉRIVE STUDIO sp. z o.o. shall not be liable for:
improper or unintended use of the object,
use contrary to its artistic, exhibition, or spatial purpose,
installation, assembly, suspension, or mounting performed by the buyer or third parties,
modifications or alterations made after delivery,
indirect, incidental, or consequential damages, including loss of profit or loss of use.
The buyer assumes full responsibility for:
the method of installation, display, or suspension of the object,
compliance with local safety regulations, building codes, and exhibition standards.
The company is not responsible for any damage, injury, or loss resulting from the handling, use, display, or installation of the objects, except where liability cannot be excluded under mandatory law.
Liability is limited to cases of intentional misconduct or gross negligence, to the maximum extent permitted by applicable law.
Nothing in these Terms limits mandatory consumer protection rights.
IX. Governing Law and Jurisdiction
These Terms are governed by Polish law.
Mandatory consumer protection provisions of the country of habitual residence of the consumer remain unaffected.
For business customers, all disputes shall be subject to the exclusive jurisdiction of the competent court in Poland.
